Our terms and conditions.

1. Acceptance of Terms

By accessing or using Muser ("Service"), you agree to be bound by these Terms of Service ("Terms"), including our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Liquid Think ("Company", "we", "us", "our").

2. Eligibility

You must be at least 13 years old to use Muser. By using the Service, you represent and warrant that you meet this requirement.

If you are using Muser on behalf of a legal entity, you represent that you have the authority to enter into these Terms on behalf of that legal entity.

3. Account Creation and Security

3.1 Account Registration

You must provide accurate and complete information when creating an account
You are responsible for maintaining the confidentiality of your account credentials
You agree to notify us immediately of any unauthorized use of your account

3.2 Username Requirements

Usernames must be between 3-20 characters
Usernames cannot contain profanity, hate speech, or impersonate others
Usernames are publicly visible and may appear in conversation histories
We reserve the right to reclaim inactive usernames or require changes to inappropriate usernames

3.3 Account Security

You are responsible for all activities that occur under your account
You agree to use a strong, unique password
You must not share your account credentials with others
You must not create multiple accounts for the purpose of circumventing bans or restrictions

4. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

4.1 Content Restrictions

Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, or otherwise objectionable
Posting or transmitting any content that incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
Posting or transmitting child sexual abuse material or any content that exploits minors
Posting or transmitting personal information about others without consent
Posting or transmitting spam, commercial solicitations, or pyramid schemes
Posting or transmitting malware, viruses, or any code designed to disrupt the Service
Impersonating any person or entity, including, but not limited to, an employee or representative of Muser

4.2 Behavioral Restrictions

Harassment: Engaging in targeted harassment, stalking, or bullying of other users
Disruption: Intentionally disrupting conversations, including but not limited to: excessive off-topic posting, spamming, or flooding rooms
Brigading: Organizing or participating in coordinated attacks on other users or conversations
Vote Manipulation: Attempting to manipulate community votes or fact-checks through fake accounts, bots, or coordination
Ban Evasion: Creating new accounts to circumvent a ban or suspension
Scraping: Using automated means to scrape or harvest data from Muser without our express written permission

4.3 Technical Restrictions

Reverse Engineering: Reverse engineering, decompiling, or disassembling any portion of the Service
API Abuse: Accessing or using the Service through any automated means, including but not limited to bots, scrapers, or scripts, without our prior written permission
Overloading: Taking any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure
Security Testing: Probing, scanning, or testing the vulnerability of the Service or any system or network

5. Community Governance

5.1 Room Participation

Each conversation room has a participant limit (default: 10 users)
Rooms are invite-only or public as designated by the room creator
You may join any public room that has available space

5.2 Fact-Checking System

Any user can flag a factual claim in a conversation for verification
Our AI system will analyze the claim and provide a verdict (True, Mostly True, Misleading, False, or Unverifiable) with sources
Fact-check results are displayed in the conversation thread
Abuse of the fact-check system (e.g., flagging opinions as facts, excessive flagging) may result in temporary loss of flagging privileges

5.3 Vote-to-Kick System

Any participant in a room can call for a vote to remove another user from that room
The vote requires a simple majority (50% + 1) of current participants to pass
Voted-out users are removed from that room only (not banned from the entire platform)
Users removed via vote-to-kick cannot rejoin that specific room for 24 hours
Abuse of the vote system (e.g., coordinating to remove users for non-violations) may result in account suspension

5.4 Moderation

We reserve the right to remove content that violates these Terms or our Community Guidelines
We reserve the right to suspend or terminate accounts that repeatedly violate these Terms
We may take action based on reports from other users or our own investigation
No Prior Notice: In cases of severe violations (e.g., illegal content, harassment), we may take immediate action without prior notice

6. Content Ownership and License

6.1 User-Generated Content

You retain full ownership of all content you post on Muser ("User Content").

6.2 License Grant

By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

Use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such User Content
Enforce our Terms and Privacy Policy
Promote and redistribute parts or all of the Service (and derivative works thereof) in any media formats and through any media channels

This license exists solely for the purpose of operating and improving the Service.

6.3 Content Removal

You may request the removal of your User Content by:

Deleting the specific post (if you are the author)
Emailing support@musers.online

We will use commercially reasonable efforts to remove your content within 48 hours of your request, except where:

The content is part of an active conversation that other users are relying on
Legal holds or investigations require us to retain the content
The content has been widely shared or cached by third parties

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Liquid Think or our content suppliers and is protected by international copyright laws.

The compilation of all content on the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, and the overall design of the Service, is the exclusive property of Liquid Think and is protected by New Zealand and international copyright laws.

7.2 Trademarks

"Muser", "Pure. Dialogue.", and related logos are trademarks of Liquid Think. You may not use these marks without our prior written permission.

8. Disclaimers and Limitations of Liability

8.1 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT ANY INFORMATION OBTAINED FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE.

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LIQUID THINK, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF NZD $1,000 OR THE AMOUNTS PAID BY YOU TO US FOR THE PAST TWELVE (12) MONTHS FOR THE SERVICE.

8.3 Indemnification

You agree to defend, indemnify, and hold harmless Liquid Think and its affiliates from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of any third party

9. Termination

9.1 By You

You may terminate your account at any time by:

Deleting your account through Settings > Account > Delete Account
Emailing support@musers.online

Account deletion is permanent and irreversible after the 30-day backup period.

9.2 By Us

We may suspend or terminate your account or access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Violation of applicable laws or regulations
Requests by law enforcement or other government agencies
Inactivity (no login for 12 consecutive months)
Our decision to discontinue the Service

Upon termination, your right to use the Service will immediately cease. We may, in our sole discretion, delete your User Content from the Service.

10. Dispute Resolution

10.1 Informal Resolution

If you have any dispute with us or another user, you agree to first attempt to resolve the dispute informally by contacting us at support@musers.online.

10.2 Governing Law

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

10.3 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of New Zealand. We and you each submit to the personal and exclusive jurisdiction of such courts.

10.4 Arbitration (Optional)

For disputes over NZD $10,000, either party may elect to resolve the dispute through binding arbitration administered by the New Zealand Dispute Resolution Centre in accordance with its rules.

11. Miscellaneous

11.1 Entire Agreement

These Terms, including the Privacy Policy, constitute the entire agreement between you and Liquid Think regarding the Service and supersede all prior agreements.

11.2 Assignment

We may assign or transfer these Terms and our rights and obligations under these Terms to any third party. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent.

11.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

11.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11.5 Force Majeure

We will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to natural disasters, acts of God, war, civil unrest, or government actions.

11.6 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via:

Email notification (if you have provided an email address)
In-app notification
Posting the updated Terms on this page

Your continued use of the Service after the effective date of any changes constitutes your acceptance of such changes.

11.7 Survival

The following sections shall survive any termination of these Terms: 4 (User Conduct), 6 (Content Ownership), 7 (Intellectual Property), 8 (Disclaimers), 9 (Termination), 10 (Dispute Resolution), and 11 (Miscellaneous).
